A Madison Heights mother and her boyfriend have been sentenced to life in prison without parole for the brutal assault and murder of the woman’s 6-year-old son in 2024.
On September 9, Elaina Rose Jennings and Daniel John Giacchina were sentenced to life in prison after being found guilty by separate juries in Oakland County. Jennings was found guilty in March of felony homicide, first-degree child abuse, and lying to a peace officer. On June 9, a jury convicted Giacchina guilty on all charges, including criminal homicide and first-degree child abuse.
The case began on July 30, 2024, when Jennings called 911 about 2:34 p.m. to report that her son, Giovanni “Chulo” Jennings, was unconscious and not breathing. Officers and firefighters from Madison Heights arrived to the home and discovered the youngster lifeless and severely injured. Emergency responders took him to Ascension Macomb-Oakland Hospital and then to Children’s Hospital of Michigan, where he died on July 31.
An autopsy revealed that Giovanni died from blunt force abdominal trauma and a ruptured intestine. Medical examiners also found bruises and wounds all over his body, as well as a BB gun injury to his crotch.
During the original inquiry, investigators stated Jennings and Giacchina planned to deceive police by falsely stating the boy was hurt while with his biological father or another person. Investigators soon cleared the father, determining that the infant was placed in Giacchina’s care.
Detectives learned that the pair kept the 6-year-old in a pen inside their bedroom, where he was repeatedly abused. Investigators discovered a BB gun and staple marks in the bedroom drywall, which confirmed accounts from other youngsters in the house that the boy had been attached to the wall as punishment for peeking out a window.
Prosecutors also obtained cellphone records indicating that the couple photographed the act and laughed about using the equipment to solve what they dubbed “the problem.”
On August 9, 2024, Oakland County Prosecutor Karen D. McDonald and Madison Heights Police Chief Brent LeMerise held a joint press conference to announce the murder and child abuse charges against the couple.
In addition to the murder and abuse allegations, Giacchina was charged with felon in possession of a firearm and ammunition, felony firearm, and lying to a police officer.
“After spending hundreds of hours carefully sifting through the evidence in this case, what we found can only be described as horrific,” McDonald said at the briefing. “Chulo was confined, beaten, and stapled to the wall. He was severely hurt, but his mother refused to take him for medical attention since she knew a medical investigation would show the abuse. “Every child deserves to be safe and secure, not terrorized and abused.”
Chief LeMerise praised the combined work of local emergency personnel and detectives.
“I am proud of the first responders who responded swiftly to the scene along with the investigators who worked around the clock alongside the Prosecutor’s Office to quickly obtain and review the evidence in this case,” LeMerise stated. “We remain focused on the victim and his family and loved ones.”
