Aiken man sentenced to nearly 3 years after tossing gun in traffic stop

An Aiken man with prior convictions for domestic violence, kidnapping, and illegally possessing a handgun was sentenced to federal prison after tossing a loaded gun during a traffic check in Five Points.

According to the U.S. Attorney’s Office, Devron Jakell Duncan, 33, has been sentenced to 33 months in federal prison for possessing a handgun as a felon.

The incident occurred about 2 a.m. on February 15, 2023, when a University of South Carolina police officer stopped Duncan’s car in the Five Points neighborhood. Prosecutors said Duncan refused to stay in the vehicle, assaulted the officer, and fled.

After apprehending him, authorities examined the area and discovered a loaded 9mm pistol that Duncan had dumped. Investigators then discovered Duncan’s girlfriend had bought the rifle and had previously told police Duncan stole it from her house.

Chief United States District Judge Sherri A. Lydon sentenced Duncan to 33 months in prison, followed by three years of supervised release.
