Lakeland Man Apprehended After Throwing Beer Bottle At Vehicle And Kicking Polk County Deputy

A 35-year-old Lakeland man faces multiple felony and misdemeanor charges following an August 4 incident at a local convenience store that ended with an officer being assaulted, according to the Polk County Sheriff’s Office.

Deputies arrived at the Nick and Moe’s store at 4410 Kathleen Road in Lakeland at 11:00 p.m. after receiving a report that a man had thrown a glass beer bottle at a car.

According to the victim, Herschel Leroy Burdine, III, was collecting money outside the store. Burdine allegedly tossed the bottle at the victim’s car when he ignored him, got into it, and drove away.

When deputies arrived at the site, they found Burdine near the store’s fuel pumps. Burdine fled on foot as authorities approached. A deputy used a Taser during the chase, but the probes missed. Burdine was captured shortly after stumbling on the wet grass.

After being detained and placed in a patrol car, Burdine began flailing around and kicking the door, causing damage to the vehicle. When a deputy opened the door to hold him, Burdine kicked the officer in the face.

Burdine was taken to the Sheriff’s Processing Center and charged with multiple offenses, including hurling a lethal missile at a car, battery on a law enforcement officer, resisting arrest with violence, resisting arrest without violence, criminal mischief, and disorderly drunkenness. Authorities discovered that he also had an active warrant for failure to pay child support.

Burdine’s criminal record includes charges for robbery, burglary, motor vehicle theft, grand theft, retail theft, battery, aggravated assault, false imprisonment, drug possession, and probation violation.
