‘She’s In There’: New York Man Pleads Guilty After Ex’s Body Found Dismembered in Suitcase

A 50‑year‑old New Yorker pleaded guilty to murder after confessing that he killed his ex‑girlfriend, dismembered her, and stashed her remains in a carry‑on suitcase.

Damon Foy admitted he killed 44‑year‑old Alberta Dale inside his Kerhonkson home after she ended their relationship. When police searched the house on April 3, 2024, they uncovered Dale’s severed head, other body parts, and a flower tucked inside the suitcase hidden in a closet.

“She’s in there,” Foy whispered to detectives during the search, then added, “I killed her.”

The find came after Dale’s family filed a missing‑person report on April 1, 2024. The following day, investigators recovered Dale’s cellphone and personal items tossed by the roadside, which led them back to Foy’s residence. Inside the apartment, officers discovered bone and tissue fragments, dried blood, pruning shears, a serrated knife, and an axe.

Court filings reveal that Foy was subject to an active stay‑away order after a prior domestic incident involving a firearm. Dale had previously warned a crime‑victims unit, saying, “if she went missing it was because [Foy] killed her.”

During questioning, Foy alleged that Dale mistreated him after their breakup. “I loved her,” he told officers. “The only thing she kept doing throughout the whole relationship was playing me, playing me like a fool… and I was told to leave my own f,ing home.”

Under the plea deal, Foy faces 23 years to life in state prison. Chief Assistant District Attorney Liz Culmone‑Mills said the victim’s family approved the terms, adding, “The District Attorney’s Office would not be making this recommendation were it not for Alberta Dale’s family.”

Foy’s formal sentencing is set for December 16.
