A Toledo police officer who was accused of driving under the influence with a youngster in the car has been sentenced.

According to court records, Toledo Police Officer Michael Ellerbrock was sentenced to five days of community service and six months of probation after being convicted of operating while intoxicated by liquor. It was an amended charge.

According to 13 Action News, Ellerbrock was placed on restricted duty last month after pleading guilty. The Toledo Police Department intended to do more investigation into the situation.

The drunk-driving incident occurred in Monroe County in March. Deputies from the Monroe County Sheriff’s Office located Ellerbrock on March 23rd after discovering his truck in a ditch near Lakeside Road.

According to the deputy, Ellerbrock was found with bloodshot, watery eyes; slurred speech; trouble providing insurance information; and a strong odor of intoxicants.

The deputy then inquired about alcohol tests with Officer Ellerbrock. The deputy states in the report: “I requested that Michael complete the standardized field sobriety tests, and Michael immediately stated, ‘I’m not going to do that.’ Michael further added, “I’m a cop, and I know that I’m just not going to do that.”

According to the report, both the first and second breath tests were invalid. On the third, he provided two samples. The first returned. 196, and the second returned. 20.

According to the report, a youngster was in the truck when it crashed.
